These Terms & Conditions explain the rules that apply when you use the LINGOIST OS website, complete the CELPIP Performance Audit, apply to the program or enroll in LINGOIST OS.

Please read them carefully before enrolling.

By using the public website, you agree to the sections that apply to website use.

By accepting an enrollment offer, agreeing to these Terms and paying the program fee, you enter into a contract with the operator identified below.

1. Who you are agreeing with

LINGOIST OS is operated by Willian Barboza Lingoist, an individual acting as a sole proprietor based in Paraguay.

In these Terms, “LINGOIST OS,” “we,” “us,” and “our” refer to Willian Barboza Lingoist and the people authorized to operate, administer or deliver LINGOIST OS.

This is a mailing address for correspondence. It is not a business location open to visitors.

2. Age and authority to agree

You must be at least the age of majority in your place of residence to enroll in LINGOIST OS.

By accepting an enrollment offer, you confirm that:

  • you have the legal capacity to enter into this agreement;
  • the information you provided during the application and enrollment process is accurate to the best of your knowledge;
  • you have had an opportunity to read these Terms before paying;
  • you understand the price, schedule, refund policy and nature of the program;
  • you are accepting the agreement for yourself and not impersonating another person.

If another person or organization pays on your behalf, you remain responsible for following these Terms as the participant.

3. Language for Québec residents

If you live in Québec, we will provide you with a French version of these Terms and the related enrollment documents before asking you to accept the agreement.

After receiving the French version, you may expressly choose to be bound by the English version.

You will not be required to pay an additional amount for the French version.

Nothing in this section limits any language right that applies to you under Québec law.

4. Using the public website

The public LINGOIST OS website is provided to:

  • explain the program;
  • share educational content;
  • send requested videos or materials;
  • allow people to complete the CELPIP Performance Audit;
  • provide access to legal and privacy information.

You may use the website only for lawful personal purposes.

You may not:

  • interfere with the operation or security of the website;
  • attempt to gain unauthorized access to an account or system;
  • introduce malicious software;
  • scrape or reproduce the website on a substantial scale;
  • impersonate another person;
  • submit knowingly false or misleading information;
  • use the website or its forms to harass, threaten or harm another person;
  • use private or proprietary materials without permission.

We may update, suspend or remove public website content when reasonably necessary.

Our Privacy Policy explains how we handle information collected through the website.

5. What LINGOIST OS is

LINGOIST OS is a 12-week live program focused on the Speaking and Writing sections of CELPIP-General.

The program is delivered through the LINGOIST OS training protocol described in these Terms.

The program works on:

  • all eight CELPIP Speaking tasks;
  • both CELPIP Writing tasks;
  • the features a strong response needs;
  • the ability to build a response in real time;
  • access to language under timed conditions;
  • the ability to recognize and recover when pressure begins to affect performance.

The goal is to help participants produce CLB 9-level Speaking and Writing more consistently under CELPIP conditions.

That goal describes the direction of the training. It is not a promise or guarantee that you will receive any particular official CELPIP score.

6. What the program includes

The Founding Cohort is designed to include the components below.

6.1 Training Team

You will be placed in a fixed Training Team designed for six participants.

Once your final Training Team assignment has been confirmed, the membership of that team will remain fixed throughout the 12-week program.

Each week includes one live Training Team session with a CELPIP Lead. The session is designed to last approximately one hour.

The CELPIP Lead teaches that week’s focus and guides the team as participants apply it to a CELPIP Speaking or Writing task.

Training Team sessions are group sessions. They are not private tutoring or individual case management.

6.2 CELPIP Performance Labs

The full cohort meets for two live CELPIP Performance Labs each week.

Each Lab is designed to last approximately one hour.

Participants continue working on the week’s focus through new prompts, different combinations of people and changing conditions.

The CELPIP Lead may use selected responses from the room to:

  • explain why something is working;
  • show where a response begins to break down;
  • give the group an adjustment;
  • provide another opportunity to apply the adjustment.

Because these are full-cohort group sessions, we do not guarantee that every participant will speak, submit a response or receive individual feedback in every Lab.

6.3 Human Performance Labs

The program includes six Human Performance Labs, generally held every second week.

Each Lab is designed to last approximately one hour.

These sessions are delivered by a Human Performance Specialist selected by LINGOIST OS.

They focus on general performance skills, including:

  • recognizing when pressure begins to change attention or thinking;
  • bringing attention back to the task;
  • recovering after a mistake;
  • continuing before one difficult moment affects everything that follows.

Human Performance Labs are educational. They are not psychotherapy, medical care, mental-health treatment or clinical assessment.

6.4 Weekly timed responses and review

Each week, you will complete:

  • one timed Speaking response;
  • one timed Writing response.

A rotating participant from your Training Team will review those responses with you using a task-specific guide.

Relevant observations may be recorded in a visual tracker.

Peer review is part of the training process. It is not an official CELPIP score, professional assessment or guarantee of how an official examiner will score the response.

6.5 Full CELPIP-General simulations

The program is designed to include one full simulation in week 6 and another in week 12.

The simulations include all four CELPIP-General skills and are designed to mirror the publicly available order and timing in effect when the simulation is delivered.

These simulations are created and administered by LINGOIST OS.

They are not official CELPIP tests, do not produce official scores and do not predict an official result.

6.6 Materials and platforms

You may also receive access to:

  • task-specific materials;
  • response guides;
  • trackers;
  • practice prompts;
  • program recordings described in these Terms;
  • a private cohort or program platform;
  • vocabulary or task-support materials;
  • other resources reasonably connected to the current program.

The exact platform, file format and organization of supporting materials may change.

LINGOIST OS is not sold as a large self-paced course or prerecorded content library. Its core is the live, cohort-based training described in these Terms.

The access period for the program platform, supporting materials and available recordings will be stated in your Enrollment Summary. Enrollment does not include lifetime access unless the Enrollment Summary expressly says so.

Ending platform access does not prevent you from retaining personal worksheets or responses that were made available for lawful download, but all LINGOIST OS intellectual-property restrictions continue to apply.

7. The group format

LINGOIST OS is a live group program.

Participation in the program does not guarantee:

  • equal speaking time in every full-cohort session;
  • individual feedback on every response;
  • private access to a CELPIP Lead outside scheduled activities;
  • private replacement lessons for missed sessions;
  • a personal case manager;
  • unlimited review of additional work;
  • a particular review partner.

CELPIP Leads, specialists and administrators will provide individual attention where reasonably possible within the group design.

8. Training Team assignment and continuity

Training Teams are organized before the program begins using the availability confirmed during the application and enrollment process.

Before the first scheduled live session, you will receive written confirmation of:

  • your assigned Training Team; and
  • the recurring day and time of your weekly Training Team session.

Once your final Training Team assignment has been confirmed, the membership of that team will remain fixed throughout the 12-week program.

LINGOIST OS will not:

  • move a participant from one Training Team to another;
  • combine or reorganize Training Teams;
  • add a new participant to an existing Training Team after the program begins; or
  • change a participant’s Training Team because their personal availability changes.

A participant’s withdrawal, removal, illness, absence or other unexpected circumstance may leave a Training Team with fewer than six participants. In that situation, the team will continue with the remaining participants.

LINGOIST OS does not guarantee that a person who leaves a Training Team will be replaced.

If your personal availability changes after your final Training Team assignment has been confirmed, you will remain assigned to the same team. Where a recording is available, you may use it to review a session you were unable to attend.

A change in personal availability does not create a right to:

  • transfer to another Training Team;
  • attend another Training Team’s session;
  • access another Training Team’s recordings;
  • receive a private replacement session; or
  • receive individual make-up instruction.

If LINGOIST OS cannot assign you to a Training Team within the availability confirmed during your application and enrollment process, you may cancel before the program begins and receive a full refund of all amounts paid to LINGOIST OS, including applicable sales taxes.

A temporary rescheduling of a session under Section 18 does not change the membership of the Training Team.

9. Who the Founding Cohort is designed for

The Founding Cohort is designed primarily for people who:

  • already use English regularly at work and in daily life;
  • are building a life in Canada;
  • score 9 or higher in Reading and Listening;
  • receive 7 or 8 in Speaking, Writing or both;
  • or have reached 9 in Speaking or Writing once but have not been able to repeat it.

These characteristics describe the people the program was built for. They do not create an automatic right to admission.

10. Application and admission

Admission may involve:

  • completing the CELPIP Performance Audit;
  • providing recent score information;
  • answering follow-up questions;
  • participating in a short call;
  • confirming your availability;
  • reviewing the program schedule;
  • confirming that the commitment and investment are realistic for you.

Completing the Audit or being invited to a call does not guarantee admission.

There is no fee to complete the Audit.

We may accept or decline an application where we believe in good faith that:

  • the program is or is not suitable for the applicant’s current situation;
  • the applicant is unlikely to benefit from the format;
  • the applicant cannot reasonably meet the program requirements;
  • admitting the applicant could negatively affect the cohort;
  • a compatible Training Team cannot be formed;
  • capacity is not available.

11. Accessibility

If you need an accessibility accommodation to participate, please tell us before accepting your enrollment and making payment.

We will discuss reasonable options with you.

An accommodation is confirmed only when we agree to it in writing.

We cannot promise an accommodation that would fundamentally change the live group format or the essential structure of the program.

Nothing in this section limits an accommodation right that applies under applicable law.

12. Your Enrollment Summary

If you are accepted, you will receive a personalized Enrollment Summary before payment.

The Enrollment Summary may be provided as a PDF, electronically signed document or another format you can save.

It will include the material details that apply to your enrollment, such as:

  • your name and email address;
  • your province, territory or country of residence;
  • the program name;
  • the planned start date;
  • the latest possible start date;
  • the 12-week duration;
  • the time zone used for live sessions;
  • your proposed Training Team day and time or, if already finalized, your confirmed Training Team assignment and recurring session time;
  • the recurring or confirmed schedule for other live components;
  • known breaks or schedule exceptions;
  • the main components included;
  • the program fee;
  • applicable sales taxes;
  • the total amount and currency;
  • the payment method available to you;
  • the refund summary;
  • the period during which you will have access to the program platform, supporting materials and available recordings;
  • which sessions are recorded;
  • the version of these Terms and the Privacy Policy that applies.

If your final Training Team assignment has not yet been confirmed when you accept your Enrollment Summary, it will be confirmed in writing before the program begins under Section 8.

You will have an opportunity to review the Enrollment Summary and ask for errors to be corrected before accepting it.

The Enrollment Summary forms part of your agreement with LINGOIST OS.

If a detail in your Enrollment Summary conflicts with a general provision in these Terms, the specific detail in the Enrollment Summary will apply to that enrollment, unless doing so would remove a right that cannot legally be waived.

13. Accepting your enrollment

Before payment, you will be asked to confirm that:

  • your Enrollment Summary is accurate;
  • you have read and agree to these Terms;
  • you have had an opportunity to read the Privacy Policy;
  • you understand which live sessions are recorded;
  • you understand the refund policy;
  • you accept the schedule and time commitment.

Acceptance may be recorded through:

  • an electronic signature;
  • required checkboxes;
  • a typed full name;
  • a dated acceptance form;
  • another electronic method that clearly records your agreement.

Agreeing to these Terms does not, by itself, give LINGOIST OS permission to send optional promotional emails or use your experience as a testimonial.

14. Planned start date

The Founding Cohort is planned to begin on September 14, 2026.

The 12-week period begins with the first scheduled live session shown in the official cohort schedule.

The expected end date and known breaks will be shown in the Enrollment Summary or current live schedule provided before payment.

15. A limited change to the start date

Because this is a live cohort program, its delivery depends on forming workable Training Teams and a workable overall cohort.

15.1 Why the date may move

We may move the September 14, 2026 start date if additional time is reasonably needed to form the Founding Cohort in a way that allows the live program to be delivered as planned.

This is not general permission to move the date indefinitely.

15.2 Maximum delay

The start date may be moved only once for this reason.

It may be moved later, never earlier, and may not be moved beyond October 9, 2026.

October 9, 2026 is the latest possible start date under these Terms.

15.3 Notice

If the date is moved because additional time is needed to form the cohort, we will notify enrolled participants by email no later than September 7, 2026.

The notice will state:

  • the new start date;
  • the reason for the change;
  • the adjusted program calendar;
  • the participant’s right to accept the new date or cancel.

15.4 Your choice if the date changes

If the planned date changes, we will ask you to confirm in writing whether you accept the new date.

You are not required to accept it.

If you do not accept the new date, you may cancel and receive a full refund of all amounts paid to LINGOIST OS, including applicable taxes.

15.5 If the program cannot begin by October 9

If the Founding Cohort cannot begin by October 9, 2026:

  • that delivery of the Founding Cohort will be cancelled;
  • enrolled participants will not be required to accept a later date;
  • all amounts paid to LINGOIST OS, including applicable taxes, will be refunded.

15.6 Effect on the refund period

If the start date moves and you accept the new date, the 14-day refund period described later in these Terms begins from the first scheduled live session on the adjusted schedule.

Nothing in this section limits any cancellation or refund right that cannot legally be waived.

16. Weekly time commitment

You should plan for approximately five to seven focused hours each week.

This estimate may include:

  • live sessions;
  • timed Speaking and Writing responses;
  • review-partner work;
  • task practice;
  • preparation;
  • simulations;
  • use of program materials.

Five to seven hours is an estimate, not a fixed maximum.

The time an individual needs may vary.

17. Live schedule

Accepted applicants will receive the current live schedule before accepting the enrollment agreement and paying.

The schedule will show the information reasonably needed to decide whether participation is realistic, including:

  • the applicable time zone;
  • the participant’s proposed Training Team time;
  • the recurring or confirmed Performance Lab times;
  • the recurring or confirmed Human Performance Lab schedule or window;
  • the simulation weeks;
  • known holidays or breaks.

A proposed Training Team time does not become the participant’s final Training Team assignment until LINGOIST OS confirms the assignment in writing under Section 8.

The Enrollment Summary may identify a date or time as provisional where it has not yet been finalized.

A participant will not be asked to pay without being told which material schedule details remain provisional.

Training Team membership will not remain provisional after the program begins.

18. Reasonable schedule changes

We may make minor and reasonable scheduling adjustments when necessary because of:

  • facilitator illness or unavailability;
  • public holidays;
  • technical problems;
  • platform outages;
  • emergencies;
  • circumstances reasonably outside our control.

Where possible, we will provide advance notice and offer one of the following:

  • a rescheduled session;
  • a substitute facilitator;
  • a reasonably equivalent session;
  • another suitable way to deliver the affected work.

A change that materially affects the weekly schedule, program duration, total live experience or a core component will be communicated as soon as reasonably possible.

If we cannot provide a reasonably equivalent replacement for a material part of the program, the remedies described in these Terms will apply.

Any rescheduling, substitute facilitator or alternative delivery arrangement under this section will preserve the membership of the affected Training Team. This section does not allow LINGOIST OS to move participants between Training Teams, combine teams or reorganize team membership.

19. Price and sales taxes

The base program fee for the Founding Cohort is CAD 3,800.

Applicable sales taxes may be added based on:

  • the participant’s location;
  • the payment method;
  • applicable tax rules;
  • the amount calculated by the payment platform where Hotmart is used.

Before paying, you will be shown:

  • the amount charged;
  • the currency;
  • applicable taxes;
  • the total amount due.

No additional program fee will be charged after enrollment unless you separately agree to purchase something else.

20. Payment through Hotmart

If Hotmart is the payment method offered in your Enrollment Summary:

  • you will receive a Hotmart checkout or payment link;
  • the purchase is also subject to Hotmart’s applicable purchasing, payment and privacy terms;
  • Hotmart processes and records the transaction through its payment system;
  • Hotmart may calculate or collect applicable taxes;
  • Hotmart may apply fraud-prevention, identity-verification or transaction-review procedures;
  • Hotmart may decline, cancel, reverse or hold a transaction under its own rules.

The contract for delivery of the LINGOIST OS program remains between you and LINGOIST OS.

Hotmart does not teach, administer or control the program.

LINGOIST OS remains responsible for the program description, delivery and commitments made in your enrollment agreement.

Your place is confirmed after:

  • Hotmart reports the transaction as approved;
  • LINGOIST OS verifies the enrollment;
  • LINGOIST OS sends you written confirmation.

A pending or rejected Hotmart transaction does not confirm a place.

21. Direct wire transfer

For one limited enrollment completed before LINGOIST OS is first offered for purchase through Hotmart, payment may be accepted by wire transfer if that method is expressly stated in the participant’s Enrollment Summary.

Once LINGOIST OS is offered for purchase through Hotmart, wire transfer will no longer be offered for the same program unless Hotmart expressly permits otherwise.

For a direct wire transfer:

  • payment instructions will be provided in writing;
  • payment must be sent only to the account identified in those instructions;
  • the full invoiced amount must be received;
  • your place is not confirmed while the payment is pending;
  • your place is confirmed only after the funds have cleared and LINGOIST OS sends written confirmation.

Unless the Enrollment Summary states otherwise, you are responsible for charges imposed by your own bank or an intermediary bank.

If bank charges result in a shortfall, we will tell you before confirming the place.

Never send money to banking instructions received from an unexpected address or message. If payment instructions appear unusual, verify them through support@lingoistos.com before sending funds.

22. Contract and payment records

After your payment is approved or cleared, we will send you a confirmation in a form you can save.

The confirmation package may include:

  • your accepted Enrollment Summary;
  • the version of these Terms you accepted;
  • the applicable Privacy Policy;
  • your invoice or Hotmart purchase record;
  • a receipt or payment confirmation;
  • the current live schedule;
  • onboarding information, when available.

We will send these documents promptly and no later than 15 calendar days after the contract is entered into.

You should keep a copy for your records.

LINGOIST OS will also retain appropriate records showing:

  • the agreement version;
  • the date and method of acceptance;
  • payment status;
  • required acknowledgements;
  • the enrollment confirmation.

23. When your place is confirmed

An acceptance message, call or verbal conversation does not by itself confirm your place.

Your place is confirmed when:

  • you have accepted your Enrollment Summary and these Terms;
  • the full payment has been approved or cleared;
  • LINGOIST OS has sent written enrollment confirmation.

Your place is personal.

It may not be sold, transferred or assigned to another person without our written agreement.

24. Cancellation before the program begins

You may cancel at any time before the first scheduled live session and receive a full refund of the amounts paid to LINGOIST OS, including applicable sales taxes.

To cancel, email support@lingoistos.com.

Your notice is effective when it is sent, provided that it clearly states your intention to cancel.

25. The 14-day refund period

You may cancel for any reason during the first 14 calendar days after the first scheduled live session of the Founding Cohort.

The first scheduled live session means the first live session shown on the official cohort schedule, whether or not you attend it.

The refund deadline is 11:59 p.m. Eastern Time on the fourteenth calendar day after that first scheduled session.

To cancel, email support@lingoistos.com before the deadline.

Your message should include:

  • your name;
  • the email used to enroll;
  • a clear statement that you are cancelling;
  • information reasonably needed to locate and return the payment.

You do not need to explain why you are cancelling.

If you cancel within this period:

  • your enrollment ends;
  • your access to program platforms, materials and recordings ends;
  • you will be removed from future sessions and Training Team activities;
  • we will refund the amounts paid to LINGOIST OS, including applicable sales taxes;
  • no administrative cancellation fee will be charged.

Missing the first session does not delay or extend the refund deadline.

26. Refunds for Hotmart purchases

A Hotmart checkout may display a platform guarantee or refund period beginning on the purchase date.

Any refund right displayed at checkout applies in addition to these Terms and does not reduce a more favourable right offered here or required by law.

If you validly cancel under these Terms after Hotmart’s automatic guarantee period has ended:

  • contact LINGOIST OS at support@lingoistos.com;
  • we will review the request under these Terms;
  • we will authorize and cooperate with the refund process where the request is valid;
  • you may be asked to submit or confirm the request through Hotmart’s refund system.

Where possible, a Hotmart refund will be returned through the original Hotmart transaction.

Hotmart, a card issuer or another financial institution may require additional processing time.

27. Refunds for direct wire transfers

A valid refund for a direct wire transfer will normally be returned to the original payer or originating account.

We may ask for information reasonably needed to verify the account and process the return.

The refund covers the amount received by LINGOIST OS, including taxes paid to us.

Bank, intermediary or foreign-exchange fees charged by third parties may not be recoverable unless applicable law requires otherwise.

We will never ask for your online banking password.

28. Refund timing

For a valid direct-payment refund, LINGOIST OS will initiate the refund within 15 calendar days after receiving a complete written cancellation notice.

For a valid Hotmart refund, LINGOIST OS will submit, approve or authorize the refund through the applicable Hotmart process within 15 calendar days after receiving a complete written cancellation notice.

A request is complete when we have enough information to:

  • identify the enrollment;
  • confirm that the request is eligible under these Terms;
  • verify the payer where reasonably necessary;
  • initiate the refund through the correct payment method.

Hotmart, banks, card issuers and intermediary institutions control how long the funds take to appear after the refund has been initiated or authorized. Their processing time is separate from LINGOIST OS’s 15-day deadline to take the action under our control.

If a refund is owed under these Terms but cannot reasonably be completed through the original Hotmart transaction, LINGOIST OS will work with the participant to arrange another lawful and reasonably practical way to return the amount owed.

29. After the refund period

After the 14-day refund period ends, the program fee is non-refundable except where:

  • applicable law requires a refund;
  • LINGOIST OS cancels the program;
  • the start-date provisions in these Terms apply;
  • we permanently fail to provide a material part of the program and do not provide a reasonable replacement;
  • we agree otherwise in writing.

There is no refund after the deadline solely because:

  • you miss sessions;
  • your work or personal schedule changes;
  • you decide not to continue;
  • you do not complete the weekly work;
  • you do not take the official CELPIP examination;
  • you receive a lower score than you hoped for;
  • your immigration plans or eligibility change;
  • you become dissatisfied with your rate of progress;
  • another participant leaves your Training Team;
  • you stop using the materials.

Nothing in this section removes a mandatory consumer right that applies where you live.

30. Chargebacks and payment disputes

If you believe a charge is incorrect, contact support@lingoistos.com so we can investigate it.

A chargeback or payment dispute does not automatically cancel your contractual obligations unless:

  • the transaction is validly reversed;
  • you exercise a cancellation right under these Terms;
  • applicable law provides otherwise.

If a payment is reversed, disputed or charged back, we may suspend program access while the issue is reviewed.

We will not use this section to penalize someone for exercising a legitimate legal or refund right.

31. Cancellation or interruption by LINGOIST OS

If we cancel the Founding Cohort before it begins, you will receive a full refund of the amounts paid to LINGOIST OS, including applicable sales taxes.

If, after the program begins, we permanently cancel a material portion and cannot provide a reasonable replacement, we will offer an appropriate remedy.

Depending on the circumstances, that remedy may include:

  • a replacement session;
  • an equivalent service;
  • transfer to an equivalent future delivery with your agreement;
  • a proportional refund for the material portion not delivered;
  • another remedy required by applicable law.

32. Events outside reasonable control

LINGOIST OS is not responsible for a delay or temporary disruption caused by an event reasonably outside our control, including:

  • widespread internet or platform outages;
  • natural disasters;
  • serious illness or emergency;
  • government action;
  • civil disruption;
  • power failure;
  • cybersecurity incidents;
  • other force majeure events.

We will still take reasonable steps to:

  • communicate what happened;
  • reduce disruption;
  • reschedule affected work;
  • provide a suitable alternative where reasonably possible.

This section does not allow LINGOIST OS to keep payment for a material service we permanently fail to provide where applicable law requires another remedy.

33. Attendance and participation

LINGOIST OS is live and participation-based.

You are responsible for:

  • reviewing the schedule;
  • attending live sessions when reasonably possible;
  • arriving prepared;
  • completing the weekly work;
  • participating respectfully;
  • maintaining access to a suitable device, microphone and internet connection;
  • checking email and program communications;
  • informing us reasonably promptly if a problem is affecting your participation.

Missing a session does not automatically entitle you to:

  • a private replacement session;
  • individual make-up instruction;
  • an extension;
  • a partial refund;
  • a change in the refund deadline.

LINGOIST OS intends to record the sessions identified as recorded in these Terms and in your Enrollment Summary.

A technical failure, incomplete recording or temporary unavailability may occasionally prevent a recording from being created or made available. A recording is a support resource and does not replace participation in the live program.

34. CELPIP Performance Lab recordings

CELPIP Performance Labs are intended to be recorded.

By enrolling and participating in a recorded Performance Lab, you understand that the recording may capture:

  • your display name;
  • your image;
  • your voice;
  • your Speaking or Writing response;
  • your questions;
  • feedback provided to you or the group.

Your voice, display name and work may be captured even if your camera is off.

Recordings are used for program delivery and may be accessed only by:

  • participants in the current cohort;
  • authorized CELPIP Leads;
  • authorized LINGOIST OS personnel;
  • service providers technically necessary to host or process the recording.

They will not be used for advertising, testimonials, public content, case studies or social media without separate permission.

Recorded Performance Labs are a material part of the program’s format.

If you have concerns about being recorded, raise them before payment.

We will explain whether a reasonable alternative is available, but we cannot guarantee an alternative that changes the live group format.

35. Training Team and Human Performance Lab recordings

Weekly Training Team sessions are intended to be recorded.

Training Team recordings allow members of the same Training Team to review the work completed during a session or watch a session they were unable to attend live.

A Training Team recording may be accessed only by:

  • members of the Training Team in which the session took place;
  • the CELPIP Lead responsible for that team;
  • authorized LINGOIST OS personnel; and
  • service providers that need access to host, secure or support the program.

Members of other Training Teams do not receive access to the recording.

A Training Team recording may capture:

  • your name or display name;
  • your profile image;
  • your image, if your camera is on;
  • your voice;
  • chat messages;
  • your Speaking or Writing responses;
  • questions or comments you make;
  • feedback provided to you or to the group;
  • other information you choose to share during the session.

Your voice, display name, responses and participation may still be captured if your camera is turned off.

Recorded Training Team sessions are a material part of the program’s format.

If you have concerns about being recorded, raise them before payment. We will explain whether a reasonable alternative is available, but we cannot guarantee an alternative that changes the live group format.

Human Performance Labs are not recorded by default.

If a particular Human Performance Lab will be recorded, participants will be informed in advance and any required consent will be requested before recording begins.

36. Recording access and deletion

The period during which program recordings are available will be communicated to participants.

A recording may be retained for internal personnel training or quality improvement only under the separate optional consent process described in the Privacy Policy. Accepting these Terms does not, by itself, provide that optional consent.

Program recordings are deleted from active LINGOIST OS systems within 30 days after the end of the 12-week program, subject to the limited exceptions described in the Privacy Policy.

A temporary technical failure, incomplete recording or unavailable recording does not create an automatic refund right when the live session itself was delivered.

37. Participant recording is prohibited

You may not record, download, photograph, screen-record, reproduce or share:

  • a live session;
  • another participant;
  • a response given by another participant;
  • a program recording;
  • a private cohort conversation;
  • a Training Team interaction;
  • private content from the cohort platform;

unless LINGOIST OS and every affected person give written permission.

38. Privacy and confidentiality inside the cohort

Live group work requires trust.

You agree to keep information shared by other participants private.

You may not disclose another participant’s:

  • name or identity;
  • image or voice;
  • test scores;
  • immigration situation;
  • professional information;
  • personal experiences;
  • Speaking or Writing responses;
  • feedback;
  • comments made during a session;
  • private cohort communications.

This obligation continues after the program ends.

LINGOIST OS will take reasonable steps to establish and enforce confidentiality expectations.

Because participants interact directly, we cannot guarantee that every participant will always follow the rules.

Use reasonable judgment when deciding what personal information to share.

A serious breach of another participant’s privacy may result in removal from the program.

39. Your Speaking and Writing responses

You retain ownership of the original Speaking and Writing responses you create.

You give LINGOIST OS a limited, non-exclusive licence to:

  • store;
  • copy;
  • display;
  • annotate;
  • review;
  • share within the program;

those responses where reasonably necessary to:

  • deliver the program;
  • provide feedback;
  • work with your review partner;
  • work with your Training Team or the current cohort;
  • maintain your tracker or participant record.

This licence does not allow us to publish your work or use it for marketing without separate permission.

40. LINGOIST OS intellectual property

The following belong to LINGOIST OS or are used by us under licence or permission:

  • the LINGOIST OS name and brand;
  • the program architecture;
  • methods and frameworks;
  • written materials;
  • original prompts;
  • task guides;
  • trackers;
  • slide decks;
  • videos;
  • recordings;
  • audio materials;
  • templates;
  • website content;
  • graphics;
  • training documents.

Enrollment gives you a limited, personal, non-exclusive, non-transferable licence to use those materials for your own CELPIP preparation during the access period communicated to you.

You do not receive ownership of the materials.

Without written permission, you may not:

  • sell them;
  • share them outside the program;
  • publish them;
  • upload them to another platform;
  • reproduce them for a class, business or client;
  • use them to create a competing product;
  • remove branding or ownership notices;
  • distribute recordings;
  • use private program materials or recordings to train an artificial-intelligence system.

You may keep a personal copy of a worksheet or response you created where downloading is allowed, but LINGOIST OS content contained in that document remains protected.

41. Test integrity

You may not use LINGOIST OS to:

  • obtain, solicit or distribute secure test questions;
  • share recalled questions from a live CELPIP examination;
  • impersonate a test taker;
  • submit another person’s work;
  • help another person misrepresent their identity or ability;
  • engage in cheating or test misconduct;
  • violate the rules of the official testing organization.

You should not upload secure or confidential test material to a LINGOIST OS platform or session.

We may remove material or take action where necessary to protect test integrity.

42. Conduct

You agree to:

  • participate honestly;
  • treat CELPIP Leads, specialists, staff and other participants respectfully;
  • avoid harassment, threats, discrimination and abusive conduct;
  • avoid intentionally disrupting sessions;
  • protect your login information;
  • follow reasonable technical and participation instructions;
  • respect the privacy and intellectual property of others;
  • avoid presenting peer feedback as an official CELPIP assessment.

43. Removal from the program

We may warn, suspend or remove a participant whose conduct is:

  • abusive;
  • threatening;
  • harassing;
  • discriminatory;
  • seriously disrespectful;
  • deliberately disruptive;
  • dishonest in a way that materially affects the program;
  • a serious breach of another participant’s privacy;
  • a serious or repeated violation of these Terms.

Where appropriate, we will explain the concern and give the participant a reasonable opportunity to correct it.

Immediate removal may occur where conduct creates a serious risk to another person, the cohort, the program or confidential information.

Removal for misconduct does not create a refund right beyond:

  • the refund rights expressly provided in these Terms;
  • any refund we agree to in writing;
  • any right required by applicable law.

44. Testimonials and case studies

Enrollment does not give LINGOIST OS permission to use your experience publicly.

We will not use your identifiable:

  • name;
  • image;
  • voice;
  • occupation;
  • scores;
  • feedback;
  • story;
  • testimonial;
  • program results;

in marketing, advertising, emails, case studies, social media or public materials without separate permission.

We may ask whether you are open to being contacted about sharing your experience.

Agreeing to be contacted is not permission to publish anything.

Any public use will require a separate written permission explaining:

  • what will be used;
  • how you will be identified;
  • where it may appear;
  • whether it may be edited;
  • whether paid advertising is included;
  • how long the permission applies.

Your decision is optional.

Refusing permission will not affect your enrollment, participation, support or relationship with LINGOIST OS.

45. What we do not guarantee

LINGOIST OS provides training, structure, practice, feedback and support.

We do not administer, control or score the official CELPIP examination.

We do not guarantee or promise:

  • a CLB 9 score;
  • any particular CELPIP score;
  • improvement by a particular number of levels;
  • a consistent official score;
  • an Invitation to Apply;
  • permanent residence;
  • a work permit;
  • an immigration outcome;
  • employment;
  • promotion;
  • admission to another institution;
  • completion of an immigration process by a particular date.

Results depend on factors outside our control, including:

  • your starting point;
  • attendance;
  • practice;
  • participation;
  • health and personal circumstances;
  • performance on test day;
  • examination content;
  • scoring decisions made by the official testing body;
  • immigration rules and government decisions.

No statement in a video, webpage, Audit response, call, email, live session, testimonial or program material changes this section unless a change is expressly included in a written agreement accepted by both sides.

46. No immigration, legal, medical or clinical advice

LINGOIST OS is an English-language performance and CELPIP preparation program.

We are not acting as:

  • an immigration consultant;
  • an immigration lawyer;
  • a lawyer in any field;
  • a financial adviser;
  • a psychologist;
  • a psychotherapist;
  • a physician;
  • a mental-health clinic.

Information about PR, Express Entry, ITAs, work permits or other immigration matters is provided only as general context.

You remain responsible for consulting an appropriately licensed professional when you need immigration, legal, medical, psychological or financial advice.

Human Performance Labs teach general performance skills. They do not diagnose or treat anxiety, trauma, attention disorders or any medical or psychological condition.

47. Independent program

LINGOIST OS is an independent preparation program.

It is not affiliated with, sponsored by, approved by or endorsed by Paragon Testing Enterprises Inc., Prometric or the official CELPIP testing organization.

LINGOIST OS does not administer official CELPIP registrations, tests, scoring or score reviews.

References to CELPIP are used only to identify the examination for which the program provides independent preparation.

The official testing organization may change:

  • test tasks;
  • policies;
  • timing;
  • scoring practices;
  • registration rules;
  • fees;
  • test availability.

We may reasonably update the program to respond to those changes.

48. Third-party platforms

The program may use third-party services for:

  • payment;
  • email;
  • video conferencing;
  • community communication;
  • file storage;
  • video hosting;
  • scheduling;
  • forms;
  • analytics.

Your use of those services may also be subject to their terms and privacy policies.

We are not responsible for a failure caused entirely by a third-party platform.

If a third-party interruption materially affects the program, we will take reasonable steps to restore access or provide an appropriate alternative.

49. Privacy

Our Privacy Policy forms part of these Terms and explains how we collect, use, share, retain and protect personal information.

By enrolling, you confirm that you have had an opportunity to read it.

Agreeing to these Terms is not consent to receive optional promotional emails.

Marketing consent, where requested, will be separate and optional.

50. Concerns and complaints

If you believe we have not delivered something promised in your enrollment agreement, contact support@lingoistos.com with a description of the issue.

We will acknowledge the message within five business days.

We will make a reasonable effort to provide a substantive response within 15 business days.

Both sides agree to make a good-faith effort to understand and resolve the concern directly before beginning formal proceedings.

Nothing in this section prevents either side from:

  • using a complaint process;
  • contacting a regulator;
  • exercising a cancellation right;
  • seeking urgent relief;
  • using another legal right available under applicable law.

51. Limitation of liability

This section applies only to the extent permitted by applicable law.

LINGOIST OS is not responsible for:

  • an official CELPIP score;
  • an immigration or employment outcome;
  • decisions made by a government, testing body, employer or other third party;
  • losses caused by your failure to attend, practise or follow reasonable instructions;
  • an interruption caused by your own device, internet connection or account;
  • indirect, incidental, special or consequential losses that were not reasonably foreseeable when the contract was formed.

To the fullest extent permitted by law, our total liability arising from the relevant enrollment will not exceed the total amount you paid to LINGOIST OS for that enrollment.

Nothing in these Terms excludes or limits:

  • liability that cannot legally be excluded;
  • liability for fraud or intentional misconduct;
  • a mandatory consumer-protection right;
  • any other right or remedy that applicable law does not allow the parties to waive.

52. Governing law and mandatory local rights

These Terms are governed by the laws of the Republic of Paraguay, without regard to conflict-of-law principles.

Choosing Paraguayan law does not remove a mandatory consumer-protection, privacy, language or contract right that applies to you and cannot legally be waived because of where you live.

If a mandatory local law gives you greater protection than these Terms, that mandatory protection continues to apply.

53. Changes to these Terms

We may update these Terms for future website use or future enrollments.

The version you accept when enrolling will govern your enrollment unless:

  • a change is required by law;
  • the change is administrative and does not materially reduce your rights;
  • the change benefits you;
  • you expressly agree to the change.

If a material change affects an active participant, we will provide reasonable notice.

We will not use a later website version to retroactively remove a material contractual right from an existing participant.

54. Transfer of the business

We may establish a company or transfer the operation of LINGOIST OS to a successor business.

If these Terms or an enrollment are assigned to a successor:

  • the successor must assume the applicable obligations;
  • existing contractual rights will continue;
  • personal information will remain subject to the Privacy Policy and applicable law.

You may not transfer your enrollment or obligations to another person without our written permission.

55. Electronic communications

You agree that we may communicate electronically about:

  • your application;
  • enrollment;
  • invoices and payment;
  • program access;
  • session schedules;
  • material changes;
  • privacy or security matters;
  • these Terms.

You are responsible for providing an accurate email address and checking it reasonably regularly.

Electronic acceptances, enrollment confirmations, invoices and emails may be retained as records of the agreement.

56. Entire agreement

These Terms, the Privacy Policy, your accepted Enrollment Summary, invoice, enrollment confirmation and any additional written condition expressly accepted by both sides form the agreement concerning your enrollment.

They replace prior informal discussions about the same subject where those discussions conflict with the written agreement.

Nothing in this section limits a right arising from a false, misleading or deceptive representation, or any right that cannot legally be waived.

57. Severability

If a court or competent authority finds one provision unenforceable, the remaining provisions continue to apply to the extent legally possible.

58. No waiver

If either side does not immediately enforce a provision, that does not permanently waive the right to enforce it later.

59. Headings

Headings are included to make these Terms easier to read.

They do not change the meaning of a provision.
